Not sure I believe that. But as he's been dealing with the case I'm not sure it would help any further if you looked into it.

My broadband & TV provider is @TalkTalk on moving in we discovered that there was no line coming in to the property and that it was a BT Openreach issue. 6 weeks later I’m still without internet. In the span of 17 month three engineer visit several wifi drop still poor wifi signal at my house. For every complain the only option they have is compensation. Less than 0.3 mbps

Escalated to open reach. Heard nothing since and job says closed on MyBT. Will I be refunded for ongoing poor connection?
